Car Rental Agreement
All vehicle rentals come with a comprehensive Rental Agreement, which you will receive upon booking confirmation or when collecting your vehicle. This agreement outlines the specific terms, conditions, insurance information, fees, and your responsibilities related to the rental. In case of any discrepancies between these Terms and the Rental Agreement, the Rental Agreement will prevail.
Eligibility Criteria
Renting a vehicle requires:
- To rent a vehicle from Car Hire in Horwich, you must be at least 21 years old, though some vehicle types may have stricter age limits, with extra fees applicable for drivers under 25. A valid full driving license is required, along with valid identification and proof of your current address. Payment information and a security deposit are also necessary, alongside any other specific requirements outlined in the Rental Agreement.
Booking and Payment Details
- Bookings can be made via our website, over the phone, or directly at our Horwich location. To confirm your reservation, a booking deposit may be necessary. The total payment, along with a security deposit, is generally required at the time of vehicle collection. All prices are listed in British Pounds (£) and include VAT where applicable. We accept major credit and debit cards, processed securely through trusted payment providers.
4. Vehicle Pickup and Drop-off
- At the time of vehicle collection, it is important to conduct a thorough inspection and report any pre-existing damage without delay. A vehicle condition report will be filled out and signed by both parties. When returning the vehicle, it should be in the same condition as when it was collected, accounting for normal wear and tear. Any new damage will be evaluated and applicable charges will be applied. The vehicle must also be returned with the same level of fuel as at collection; otherwise, refueling fees will be incurred. Late returns may result in additional charges, so please notify us promptly if you anticipate a delay. You will be liable for any parking fines, traffic violations, or other charges that occur during your rental, along with a related administration fee.
Insurance and Liability Terms
- All rental agreements include basic third-party insurance. Details regarding coverage and excess amounts can be found in your Rental Agreement. You may have the option to purchase additional insurance to lower your financial liability. It is advisable to review these options thoroughly. You will be liable for damage or loss up to the insurance excess unless you opt for added coverage. Any damage resulting from negligence, misuse, or violation of these Terms will remain your responsibility, regardless of insurance.
Cancellation and Modifications
Cancellation and amendment policies depend on the type of booking and the notice given. For precise information, please consult your booking confirmation or Rental Agreement. Be aware that late cancellations or failure to show may incur additional charges.
Prohibited Activities
Prohibited Uses of the Vehicle
- Use of the vehicle for any unlawful activities is strictly prohibited. Engaging in racing, rallying, off-roading, or similar risky pursuits is not allowed. The transport of hazardous materials is forbidden. Sub-letting the vehicle or permitting unauthorized drivers is not permitted. Operating the vehicle under the influence of alcohol or drugs is unacceptable. Usage beyond the vehicle’s intended purpose or exceeding passenger and weight limits is against policy. Additionally, driving outside designated geographical boundaries requires prior approval.
Breach of these terms may lead to rental termination and extra fees.
8. Liability Restrictions
To the fullest extent allowed under English and Welsh law, Car Hire Horwich is not responsible for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business, resulting from your use of our services. Our total liability for any claim is limited to the amount paid for the rental in the previous 12 months. This limitation does not apply to liability for death or personal injury resulting from negligence, or for fraud.
9. Applicable Law
These Terms are governed by the laws of England and Wales. Disputes will be resolved exclusively in English and Welsh courts.
10. Terms Updates
We reserve the right to amend these Terms at any time. Updates take effect immediately upon posting on our website. Continued use of our services indicates your acceptance of the revised Terms.
